Terms of Service

By accessing or using the Amour Chatting platform ("Platform"), operated by Amour Chatting ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users of the Platform, including Creators (those who hire chatters), Chatters (those who provide chatting services), and Agencies (organizations that manage multiple creator accounts).

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. You must provide accurate, complete, and current information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials.

Amour Chatting is a marketplace that connects content creators with professional chatters. The Platform provides: - A marketplace for browsing and hiring vetted chatting professionals - Tools for managing chatter schedules, shifts, and coverage - Secure messaging between creators and chatters - Payment processing for chatter services - Performance insights and analytics The Platform acts as an intermediary and is not a party to any agreement between Creators and Chatters. We do not guarantee any specific results, revenue increases, or outcomes from using our services.

Creator Accounts: Creators are responsible for providing accurate account information, including revenue data used for service recommendations. Creators are responsible for any platform credentials they share with chatters through our secure credential system. Chatter Accounts: Chatters must complete our vetting process and maintain professional standards. Chatters must not share, redistribute, or misuse any creator account credentials or subscriber information they access through the Platform. Agency Accounts: Agencies may manage multiple creator accounts and are responsible for ensuring all managed accounts comply with these Terms.

All payments are processed through Stripe, a PCI-compliant payment processor. By making a purchase, you agree to Stripe's terms of service. Hourly Services: Chatter services are billed on a weekly recurring basis based on the hours and days selected. Rates are determined by the chatter's tier (Rising, Pro, or Elite). Commission-Only and Custom Arrangements: Some services may be offered on a commission-only or hybrid basis as agreed between parties through the Platform. VIP Subscriptions: Monthly subscriptions for premium platform features are billed monthly and renew automatically until cancelled. Premium Add-ons: One-time purchases for messaging credits, insights, and other features are non-refundable once used. All prices are in USD unless otherwise stated. You are responsible for any applicable taxes.

ALL PAYMENTS MADE THROUGH THE PLATFORM ARE FINAL AND NON-REFUNDABLE. By completing a purchase, you acknowledge and agree to the following: - No monetary refunds will be issued under any circumstances, including but not limited to: dissatisfaction with a chatter's performance, unused service time, early cancellation, or change of mind. - In cases of documented service failure -- such as a chatter failing to appear for scheduled shifts, verified account misuse, or gross negligence -- Amour Chatting may, at its sole discretion, issue Platform Credit to your account. - Platform Credit can only be applied toward hiring a replacement chatter, booking additional services, or purchasing other offerings on the Platform. Platform Credit has no cash value and cannot be transferred, sold, or redeemed for monetary payment. - Platform Credit expires 90 days from the date of issuance. Any unused credit after 90 days is forfeited. - Filing a chargeback or payment dispute with your bank or credit card company in violation of this no-refund policy constitutes a breach of these Terms and may result in immediate account termination, forfeiture of any remaining Platform Credit, and pursuit of the disputed amount through collections. You may cancel your chatter services at any time from your account dashboard. Cancellations take effect at the end of the current billing period. No refunds or credits are issued for the remaining days in an active billing cycle. VIP subscriptions may be cancelled at any time. No refunds or credits are provided for partial billing periods. You agree not to: - Use the Platform for any illegal purpose or in violation of any applicable laws - Share, sell, or transfer your account to another person - Attempt to circumvent the Platform to arrange services directly with chatters or creators outside of Amour Chatting - Harass, abuse, or threaten other users of the Platform - Upload or transmit any malicious code, viruses, or harmful content - Scrape, crawl, or use automated means to access the Platform - Misrepresent your identity, revenue, or account information - Use another user's account credentials without authorization - Engage in any activity that could damage, disable, or impair the Platform We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

When sharing platform credentials (such as OnlyFans login details) with chatters through our secure credential system, you acknowledge that: - You are sharing credentials at your own risk - Amour Chatting provides a secure credential transfer system but cannot guarantee against all unauthorized access - You should change your credentials immediately if you suspect any unauthorized use - You are responsible for revoking access when a chatter's services are terminated - Amour Chatting is not liable for any losses resulting from unauthorized access to your third-party accounts

The Platform, including its design, features, content, and branding, is owned by Amour Chatting and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Platform without our written consent. Content created by chatters on behalf of creators during the course of their services belongs to the creator. Chatters retain no rights to content created for or on behalf of a creator's accounts.

To the maximum extent permitted by law, Amour Chatting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of the Platform. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim. We do not guarantee uninterrupted or error-free operation of the Platform. We are not responsible for the actions, content, or conduct of any user on or off the Platform.

You agree to indemnify, defend, and hold harmless Amour Chatting, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

We may terminate or suspend your account at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will survive.
